Terms and Conditions of sale

PREAMBLE

  1. Of the one part, Squamers Mosaic S.L. (hereinafter, STOCK MOSAIC), Tax ID No. B12982799, registered in the Mercantile Registry of Castellón (Tomo 1725, Libro 1286, Folio 33, Sección 8, Hoja 39697, Inscripción 2), owner of the website stockmosaic.com .
  2. And of the other part, any person who places an order (hereinafter, the CUSTOMER), whose data entered when making the purchase, by means of the established form, are those that have been entered by him/her. The responsibility for the authenticity of the same corresponds directly and exclusively to the CUSTOMER.

ARTICLE 1 – PURPOSE

The present Terms and Conditions of Sale aim at defining the modalities of sale between the CUSTOMER and STOCK MOSAIC, including the placing of the order, delivery and payment.

The placing of an order implies the acceptance of the present Terms and Conditions of Sale by the CUSTOMER, as well as any other specified in the order itself.

Orders are shipped exclusively within the Spanish territory of the Iberian Peninsula and the Balearic Islands (orders are not shipped to Bosnia, Norway, Russia, Switzerland, Turkey, United Kingdom, Canary Islands, Ceuta and Melilla) and the European Union.

Access to information is completely free of charge, whereas the service of purchasing products is onerous, specifying the current prices of the product, the prices of postage and tax charges.

 

ARTICLE 2 – ORDER

STOCK MOSAIC provides the CUSTOMER with two ways to place an order:

– Online, on the stockmosaic.com website, following the established procedure.

-By e-mail: info@stockmosaic.com, stating the products, quantity, delivery address, billing address, name and telephone number of the contact person. In this case the allowed payment methods are bank transfer or Bizum. In order to process the order, a written acceptance of the generated quotation and the sending of the proof of payment (document in .pdf or .jpg format) are required.

In order to process the order, the CUSTOMER must provide the personal data requested by any of the above procedures.

By placing the order, the CUSTOMER fully and completely accepts the prices, the description of the products for sale and the Terms and Conditions of Sale, as well as any other information specified in the order itself.

Upon completion of the contracting procedure, the CUSTOMER shall receive an e-mail to the address provided in the sign-up phase, which will show all the information related to the purchase.

Should it be necessary, STOCK MOSAIC will inform the CUSTOMER, as soon as possible, of the unavailability of the requested product.

The email will be sent within a maximum period of 24 hours as established by law. Nevertheless, as this email is automatically generated, there may occur errors that are beyond the control of the person in charge of the website, therefore the CLIENT is requested to inform STOCK MOSAIC (info@stockmosaic.com) if he/she does not receive such email.

 

ARTICLE 3 – DELIVERY

The CUSTOMER shall receive detailed information on the delivery dates of the different products. For any questions or clarification, the CUSTOMER may contact STOCK MOSAIC via e-mail (info@stockmosaic.com).

Delivery charges to the delivery address provided by the CUSTOMER in the order are included in the sales price.

The CUSTOMER shall receive the goods at the address provided when making the purchase. The goods are always delivered ON THE STREET. As they are not authorized to handle the goods, the carriers always unload ON STREET, that is to say, they do not take the goods up to the houses.  Therefore, it is likely that they will need help to get the goods into your house.

Unloading will take place provided there is sufficient space for unloading and it does not obstruct the unloading or there is enough space for the unloading vehicle.

When placing the order, it is essential to report any inconvenience that may make it difficult or impossible for the carrier to reach the destination address. If the goods cannot be unloaded, an alternative delivery point will be arranged. All the derived costs shall be borne by the CUSTOMER.

STOCK MOSAIC shall not be liable when the delivery cannot be made as a result of incorrect, inaccurate or incomplete data provided by the customer. Therefore, the customer must make sure to place the order with the CORRECT DELIVERY ADDRESS. IT IS MANDATORY TO NOTIFY THE TELEPHONE NUMBER OF THE PERSON WHO WILL BE RECEIVING THE GOODS.

IN THE CASE THAT THE CUSTOMER IS NOT AT THE DELIVERY ADDRESS when the order is delivered, the agency will leave a notice for the customer to contact the delivery service. In this case any additional costs that may be incurred will be borne by the customer.

As soon as the order has been handed over to the transport agency, the customer will be notified by e-mail so that he/she can monitor the receipt of the order.

Upon receipt of the goods, it is mandatory that the customer checks that everything is in accordance with the order and in perfect condition. If you are not satisfied with the products delivered, please sign and write by hand on the delivery note the defects you found upon receipt.

In case of any incident related to the transport of the goods, the deadline for claiming to the transport company is 24 hours from the date of receipt of the product. After this period, the CUSTOMER will be responsible for the transport costs generated. In the event of any incident or query, please contact us by e-mail at info@stockmosaic.com .

If any reference of the products received did not match with the one in the confirmation e-mail, the CUSTOMER shall contact STOCK MOSAIC by e-mail ( info@stockmosaic.com) to correct such error at the earliest convenience.

On the other hand, the CLIENT should receive the ORDER NUMBER with the order confirmation e-mail.

Once the order has been delivered, the CUSTOMER will receive, by e-mail, the corresponding invoice in pdf format. STOCK MOSAIC will keep a digital copy of such invoices. In case of error in the invoice, the CUSTOMER may contact STOCK MOSAIC by sending an email to info@stockmosaic.com requesting the correction of the error. STOCK MOSAIC undertakes to correct the error within a maximum of 5 business days.

 

ARTICLE 4 – PAYMENT

STOCK MOSAIC provides the CUSTOMER with three methods of payment:
  1. Paypal.
  2. Direct payment through our web site. We use the Redsys payment gateway. For the buyer’s security, we delegate the responsibility to a company specialized in Internet payments, with a high PCI compliance (security system when paying online) used by banks and major companies.
  3. Bizum.


ARTICLE 5 – PRICES

All sales prices specified on the STOCK MOSAIC website are in EUROS including VAT. Shipping costs to the delivery address specified by the customer are included in the sales price.

STOCK MOSAIC reserves the right to modify its prices at any time. It nevertheless undertakes to apply the rates in force specified on the website, except in case of error or omission, at the time of placing your order.

Should there be a typographical mistake in any of the prices or products displayed, and the CUSTOMER had made a purchase decision based on such mistake, STOCK MOSAIC will communicate such mistake to the CUSTOMER, and the CUSTOMER will either have to cancel the purchase (at no cost on his/her part) or to adhere to the new conditions and price communicated.

 

ARTICLE 6 – RETURNS

STOCK MOSAIC accepts returns within 14 days after receipt of the goods by the CUSTOMER, provided that it has not been explicitly stated in the item sheet that no returns are allowed, for which no returns will be accepted.

The CUSTOMER may always return a product for any of the following reasons:

  • Defective product.
  • Error in the shipment and the reference supplied does not correspond to the one that appears in the order.
  • The product does not meet the expectations of the CUSTOMER.

The return costs vary depending on the reason for the return:

  • If the return is due to a defect in the product or a shipping error, the shipping costs will be paid by STOCK MOSAIC.
  • If the return is due to the product not meeting the CUSTOMER’s expectations, the shipping costs will be paid by the CUSTOMER. In this case, either STOCK MOSAIC manages the shipping (but not the payment) of the return through its transport agencies, or the CUSTOMER hires an external agency at its own expense.

Materials already placed are expressly excluded from the return policy.

Once the returned goods received, they are checked by the technical service of STOCK MOSAIC and, if everything is correct, STOCK MOSAIC will accept the return and proceed to the corresponding refund to the CUSTOMER.

STOCK MOSAIC will pay only the value of the products to be returned (not the associated shipping costs), therefore, the shipping costs of the return will always be borne by the CUSTOMER.

The refund of the amount corresponding to the return will always be made with the same method used by the CUSTOMER for the payment of the initial order.

 

ARTICLE 7 – WARRANTIES AND CLAIMS

All products sold on the stockmosaic.com  website are covered by a TWO YEARS warranty.

Should the CUSTOMER need to make use of the warranty, he or she should contact STOCK MOSAIC by email at info@stockmosaic.com . STOCK MOSAIC shall inform the CUSTOMER about the steps to follow for the quick solution of the incident.

The CUSTOMER will not be able to make use of the warranty in case of defects and deterioration due to external circumstances, accidents, and installation and use of the products not in accordance with the instructions. The warranty also excludes products modified or repaired by the CUSTOMER or any other person not authorized by the manufacturer.

Claims on material already installed are not accepted.

 

ARTICLE 8 – PRIVACY POLICY AND LIABILITY

STOCK MOSAIC ensures that the processing of personal data will be carried out under security levels that prevent their loss, manipulation or unauthorized access. In compliance with the provisions of the Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights and the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, STOCK MOSAIC informs that all data provided by the CUSTOMER, by any means, through the order form and throughout the commercial relationship, will be incorporated into a file whose owner and responsible is STOCK MOSAIC and will be treated with the utmost confidentiality. The purpose of the collection and treatment of the data is to manage the commercial relationship and to manage the requests and/or orders and their payment collection.

These data will be kept as long as the deletion is not requested by the interested party and no transfer of data is foreseen except in cases where there is a legal obligation.

You may exercise these rights at any time by writing to Squamers Mosaic, S.L., Avenida Palmeral, 23, 12200, Onda (Castellón), or through the e-mail address: info@stockmosaic.com. In addition, you may file a complaint with the supervisory authority, in this case, the Spanish Data Protection Agency, if you consider that the processing of personal data violates the applicable law.

In the event that the Web sites owned by STOCK MOSAIC host banners that allow the user to access Web pages or links owned by third parties, STOCK MOSAIC is not liable for the contents that may be hosted therein and will proceed to remove them in the event that any user communicates any type of illicit content, once verified.

 

ARTICLE 9 – TOTAL AGREEMENT

The present Terms and Conditions of Sale constitute the total agreement between the parties concerned.

In the event that one of the clauses of the present Terms and Conditions is null and void, the remaining conditions shall not be affected.

 

ARTICLE 10 – APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Sale must be interpreted and are governed by the Spanish legislation in force.

For the resolution of any doubt, discrepancy or conflict that may arise in the performance and interpretation of this Agreement, the parties submit to the Courts and Tribunals of Castellón. However, this shall not prevent STOCK MOSAIC from exercising the right to resolve any dispute in another competent jurisdiction.
